If the person you are caring for does not meet the Fair Work Act’s definition of an immediate family or household member, a carer’s leave certificate would not be appropriate to request.
An unexpected emergency generally refers to a sudden or unforeseen situation that creates an urgent need for you to provide care or support. It is not limited to illness or injury.
Whether a situation qualifies depends on the circumstances. Relevant factors may include how much notice you had, whether alternative work or care arrangements were available, and the age or independence of the person requiring care.

Under the Fair Work Act 2009, an employer can request reasonable evidence to support a carer’s leave claim. This applies even if the absence was for one day or less. The evidence provided must be enough to convince a reasonable person that the employee was entitled to the leave.
